Apply when booking a student truck
Terms and conditions for graduation drives
The parties to the agreement are: EventTrucks ApS, which in our terms and conditions will be referred to as the lessor (udlejer). The customer of EventTrucks ApS will be referred to as the hirer (lejer).
1. Time and place
The drive takes place on the agreed date.
No later than 1 March of the year in which the drive is agreed, the hirer is obliged to send a route plan containing the following:
- Names of the students who belong to the class and have passed their exams
- Addresses of the places the hirer wishes to visit, in the desired order
- The time the truck must arrive at the first stop and a schedule of the day’s visits with estimated arrival and departure times
- In accordance with the driving and rest time rules, a 30-minute stop must be planned around the last third of the trip.
1. Time and place – approval of the route plan
The route plan must be approved by the lessor before it is valid. (Driving on motorways and expressways is not legal during a graduation drive.) The hirer must fill in the route plan document, which will be sent to the hirer’s email together with the contract. If the document sent is not filled in, an administration fee of DKK 1,000 is charged for the lessor to fill in the template. In this case, the lessor disclaims all responsibility for errors in the route plan if it is not submitted in the attached template. If the route plan is subsequently edited, the hirer must make sure to send the updated route plan to the lessor. After 1 March, it can only be approved by agreement with the lessor.
2. Payment
- The price of the drive is agreed between the lessor and the hirer when booking. Payment is made in 2 or 3 instalments.
- Instalment 1 must be paid no later than two weeks after booking, unless otherwise agreed. Instalment 1 is the so-called deposit, which is part of the agreed price and will not be refunded.
- The date is only booked once instalment 1 has been received.
- Instalments 2 and 3 are the remaining amount, and the time of payment is agreed with the lessor. However, the final instalment must be paid no later than 1 March of the year in which the drive is agreed. Each instalment must be paid as one single amount. The invoice number must be stated on the transfers.
- If payments are not received by the agreed date, an administration fee of DKK 100 per day overdue is added to the agreed price, unless otherwise agreed between the lessor and the hirer.
- As a rule, the drive consists of 10 hours. Tape or other materials that may damage the truck’s paintwork must not be used when decorating it – the hirer is liable for any damage. The view from the mirrors must not be blocked when decorating.
- An extra hour can be purchased in some cases. This is possible provided that the driving and rest time rules and the Working Time Directive can be complied with and the lessor approves it.
3. Cancellation or interruption
- If the hirer cancels the drive, amounts already paid will not be refunded. If the cancellation is made when there are less than 12 months until the drive, the full price of the drive must be paid to the lessor.
- The lessor may cancel due to section 5, Force majeure, or if the hirer fails to pay.
- Should the student truck, against all expectations, suffer an engine failure or similar during the drive, and the lessor is unable to repair it on the spot, we have a backup student truck and party bus on standby in case of a breakdown. If these are also in use, the amount will be refunded for the students whose homes we have not visited. (EventTrucks ApS has not yet had to cancel a graduation drive.)
- The lessor may cancel during the drive if guests who do not belong to the class and the rules for exam drives are brought onto the truck, if the hirer climbs out over the truck’s structure, and if objects are thrown from the truck, as the Danish Road Traffic Act (færdselsloven) prohibits dropping goods while driving.
- When driving in residential areas where there is a risk of being attacked with thrown objects, EventTrucks ApS may be forced to interrupt the planned stop and continue to the next stop on the route. The interrupted or cancelled stop will not be refunded. This is the lessor’s priority in order to avoid unnecessary harm to the hirer, employees and the vehicle. This is covered by section 5, Force majeure, and is classed as vandalism. Better safe than sorry.
4. General conditions
- The hirer is responsible for ensuring that all participants have been made aware of the content and conditions of this contract.
- The lessor is responsible for ensuring that all necessary approvals and insurance have been obtained and that the vehicle has been mechanically inspected.
- The lessor’s trucks pass a new vehicle inspection every year and carry statutory insurance covering the driver and those on the platform during the drive. The associated rules, such as speed and driving and rest times, are of course complied with. The lessor carries documentation of the above and can show it in the vehicle folder.
- The hire includes a thorough cleaning of the truck after the drive, free mileage and fuel. With one exception: if fuel prices, fuel duties or general taxes rise unpredictably due to, for example, war, inflation, the green transition or any other reason, an extra fee may be added for the drive.
- Costs related to the drive, such as bridge tolls and ferry fares, are paid by the hirer.
5. Force majeure
Notwithstanding any conflicting terms in the agreement, EventTrucks ApS is not liable to the hirer for failure to fulfil obligations attributable to force majeure. This exemption from liability applies for as long as the force majeure lasts. Force majeure means circumstances beyond our control which we could not have foreseen when the agreement was made. Examples of force majeure are unusual natural conditions, war, terrorism, fire, epidemics, flooding, vandalism and violence. Amounts already paid will not be refunded in the event of the above.
6. Right of withdrawal
The hirer may withdraw from the purchase under § 17 of the Danish consumer act (forbrugerloven). The withdrawal period is 14 days and runs from the booking date.
